12.5. Our failure to deliver shall not entitle either party to treat this contract or any part thereof as void.
12.6. We shall not be liable for any loss or damage incurred by you whatsoever, due to the failure to deliver the Goods promptly or at all.

13.1. If you notify us within 14 days of receipt that you are not completely satisfied with the Goods for any reason, we will refund the Price (not
including the cost of delivery) minus a 20% re-stocking fee, upon your returning the Goods to us.
13.2. Returns will only be accepted and refunds provided if the Goods are returned at your cost and with all protective packaging materials intact, and subject to the Goods being returned as new, undamaged and in saleable condition.
13.3. Delivery charges are non-refundable and all costs of returning the Goods to us are your responsibility.

14.1. The provisions of these Terms and Conditions are strictly confidential to the parties. Neither party may disclose or permit to be disclosed any provision of, or any information (and particularly any financial information) relating to the contract the subject of these Terms and Conditions to any person not a party to them without first obtaining the written consent of the other party as to both the person to whom disclosure is to be made and the terms of such disclosure.

15.3. The rights to intellectual property as set out in this clause 15 shall not limit our confidentiality obligations as provided by clause 13.3.

16.1. Where a Force Majeure Event gives rise to a failure or delay in either Party performing its obligations required by this agreement (other than obligations to make payment),
those obligations will be suspended for the duration of the Force Majeure Event.
16.2. Where a Party’s obligations have been suspended pursuant to clause 16.1 for a period of 90 days or more, the other party may immediately terminate this Agreement by giving notice in writing to the other Party.

17.1. We provide no warranty and make no claim as to the suitability of the Goods for your intended use and you shall be solely responsible for determining the suitability, compliance to standard, and any specific performance requirements your intended use of the Goods may include. In the event that you rely upon test results in relation to products manufactured from the Goods you are responsible for the performance and the repeat testing of any products manufactured from Goods provided at a different point in time.
17.2. Goods are not necessarily colour fast and may fade under certain circumstances without necessarily impacting the performance quality of the Goods (for example by continuing to remain waterproof).

17.3.1. the Website being unavailable (in whole or in part) or performing slowly;

17.4. We make no representation or warranty that the Website is appropriate or available for use in all countries or that the content satisfies the laws of all countries. You are responsible for ensuring that your access to and use of the Website is not illegal or prohibited, and for your own compliance with applicable laws in your jurisdiction.

18.1. To the maximum extent permitted by law:
18.1.1. you access and use the Website at your own risk; and
18.1.2. we are not liable or responsible to you or any other person for any Loss under or in connection with these Terms and Conditions, the Website, or your access and use of (or inability to access or use) the Website. This exclusion applies regardless of whether our liability or responsibility arises in contract, tort (including negligence), equity, breach of statutory duty, or otherwise.
18.2. Except to the extent permitted by law, nothing in these Terms and Conditions has the effect of contracting out of the New Zealand Consumer Guarantees Act 1993 or any other consumer protection law that cannot be excluded. To the extent our liability cannot be excluded but can be limited, our liability is limited to the price of the Goods.
18.3. To the maximum extent permitted by law and only to the extent clauses 18.1 and 18.2 of these Terms and Conditions do not apply, our total liability to you under or in connection with these Terms and Conditions, or in connection with the Website, or your access and use of (or inability to access or use) the Website, does not exceed the price of the Goods.
